Criminal Defense

David R. Addelman has experience defending cases from DWIs and shoplifting charges, through the most serious felonies. Mr. Addelman has successfully handled homicide cases, drug charges, robbery and burglary cases through jury verdict.   

The firm's practice includes the local criminal courts of Western New York; Buffalo, Lackawana, Niagara Falls and Lockport City Courts; Erie, Niagara, Genesee, Chautauqua, Allegany and Cattaraugus County Courts, New York State Supreme Court, as well as Federal Court practice. We also handle appeals of both State Court Judgments and appeals to the Second Circuit Court of Appeals for Federal Court decisions.

Some of our recent successes include:

  • Tried high profile First Degree Murder case.  Jury acquitted this firm's cient of all charges of intentional Murder including two counts of Murder in the First Degree.  The Trial Judge later advised Mr. Addelman that she had never seen a defendant receive better represention than was provided to this client.  This case was widely publicized throughout Western New York and received national media attention.
  • Tried attempted murder case in which there were 3 eyewitness identifications of the defendant.  Mr. Addelman successfully presented an alibi defense to the charges.  Jury acquitted on all counts. Defendant was facing a sentence of up to 20 years imprisonment.
  • Tried burglary case with potential for a life sentence because client would have been sentenced as a persistent felony offender if he were convicted.  Jury acquitted on both felony counts after trial.  Client was immediately released from custody.  This result likely saved our client decades of incarceration.
  • Tried Criminal Possession of a Weapon case to verdict.  Client would have faced a minimum of seven years in NYS prison if convicted.  Found not guilty on both felony charges.
  • Represented defendant in Federal criminal matter in which the US Attorney's Office requested authorization to seek the death penalty.  This firm's representation was terminated in Federal District Court when the Attorney General elected not to seek the death penalty as a sentencing option.
