DID YOU KNOW:

  • That effective October 15, 2010 New York State now permits a “no fault" divorce? This is a change from the previous requirement that you must have grounds to obtain a divorce or separation in New York State.
  • Both parents are legally obligated for the support of a child, even if they were never married.
  • Child Support in New York is generally based upon a percentage of income and is set forth in the law.
  • Most property acquired during marriage is considered marital property regardless of the title to the property, and all marital property is subject to distribution at the time of divorce.
  • If you do not file a separate order, known as a Qualified Domestic Relations Order (in addition to your Judgment of Divorce), you may not receive any of your spouse's pension benefits, regardless of what was in your written agreement.
